EXCLUSIVE: FA statement on Luis Suarez's Fulham charge...

At the end of the Fulham game recently, Luis Suarez made an 'obscene gesture', allegedly in the direction of the crowd. In January 2010, Gary Neville was photographed making an obscene gesture at Carlos Tevez. Suarez was charged; Neville wasn't, which seems unfair. As such, I contacted the FA to find out why Man United's Neville escaped a charge, or if indeed he was even investigated.

There's no evidence to suggest that Neville was officially investigated for the middle-finger salute at Tevez, and the FA's statement on the issue seems to confirm this.

There rules on obscene gestures seem to be a little inconsistent, which is why I approached the FA for official clarification. A spokesperson for the FA stated:

"With regards to player-on-player gestures, the view is that generally speaking retrospective action is rarely likely to be appropriate, although not ruled out together, or indeed proportionate given that players are seen to berate and engage with each other in relatively strong terms.

"With Suarez's gesture towards the crowd, there was a potential of incitement and as such there is a responsibility of all participants to refrain from inflammatory actions which could lead to crowd problems.

"Taking all this into consideration, the Football Association deemed that the behaviour of the player in question [Gary Neville] was not deemed to have been a breach of conduct".


So, according to the FA, it's perfectly okay for players to go around making obscene gestures at other players (!)

Past FA decisions seem to suggest that Suarez should receive no more than a fine, but if he's banned, it would be understandable given the 'crowd incitement' issue.

The FA says there is the "potential for incitement" when a player gestures towards the crowd.  Try this scenario: Rooney pulls an obscene gesture to our beloved Suarez!  The FA doesn't think there is the potential for incitement by the crowd in such an instance! Me thinks they're clutching at straws! Get real FA - no-one's buying it!

    * It establishes that the FA did not investigate Neville's gesture

    * It provides an official reason why Suarez was charged and Neville wasn't.

  15. ah now, there is no point in looking too far back to gary neville. The important precedent here is when rooney was banned for swearing into the camera. From that point on then this sort of thing is always going to get punished. And to be fair, it probably should.

Evra is the scumbag as he has already lied about Finnan and I think the Chelsea groundsman too and is making a meal out of this just because he plays for us, if it was a small team he would of just laughed it off. He is the boy who cried wolf and will always be remembered for it. And as for putting fingers up to the crowd, it has been done hundreds of times in the past, it's not even worth talking about.

I think he was using it as an insult because he has lived in europe long enough to no that u dont use words like that. if he went around the streets in england using that word when talking to people he would be asking for serious trouble. he is either incredibely stupid or he is racist. putting fingers up at the crowd when ur a highly paid pro is also very stupid especialy when u might already be getting one ban, even if it has been done before doesnt make it acceptable in his case.

  23. I doubt Evra even knew what it meant before he filed a complaint, he probably feels stupid now but has to carry on with the case. I believe Suarez will get a 3 match ban or something as the FA need to make an example of someone so any cases that come up in the future will be sorted out quicker and they will know how to deal with any 'racist' comments complaints.

  30. What about when Neville ran the length of the pitch to goad the Liverpool fans after the mancs snuck in another one of their late winners in the 53rd minute of injury time?  Was that inciting the crowd?

    Or when Adebayor did the same thing to Arsenal fans?

    In respect of the FA's statement, both these actions were far more inflammatory than Suarez's gesture. Singling out Suarez in light of many other previous players indiscretions can certainly be considered as prejudice.

    Unfortunately footballing governing bodies are a lot like the North Korean government - Run by egomaniacs, riddled to the core with corruption and wholly and completely out of touch with the rest of the populace - and as such will never truly be able to impartially administer justice.

  35. Kinda double standards here when you consider the sending off offences as listed in the Laws of Association Football include:

    "Using offensive, insulting or abusive language and/or gestures" ... and when I trained as a referee it was made clear that these were red card offences NO MATTER WHO they were directed towards ...

    So the FA are implying that Gary Neville should not be punished for committing a stone wall dismissal offence.

To all the utd fans who posted comments on here about Suarez and the situation - what about Evra gesturing to the Liverpool fans repeatedly kissing his badge which evidently is incitement do you believe he should receive the same punishment that Suarez receives?   40. Based on no evidence not even by ur own players. THe decision was made by a jury style verdict of word vs word. One such party (as shown in the press) is a known friend of SAF and has him mentioned as such in his book yet he was on the panel.

  41. Fixed jury, punished with no evidence other than word vs word. Disgracefull, yet even with video evidence Terry still awaits decisions and gets no mention. 
    Suarez has been used as a scapegoat for the FA to look strong on racism so they cant be called hypocrites while they call for blatters head.
    There is a lot of this going on at the moment and the decisions on action seem to depend on who it is rather than what actually happened or is proven to have happend.
    Most neutrals have shown disgust in this decision and/or amazed/puzzled as to how this has been found as such. 
    Manu fans will all say its the right decision as they always do and never have i seen them agree that one of there's were in the wrong or admit a rival player wasn't.
    Liverpool fans, have lambasted their own however in the past for stupidity and if evidence is brought to show he was racist would be the same now how ever no one has any reason to believe it.
    Oh and biting someones ear or saving a goal does not mean one is bound to be a racist too by default cos they are, how scum fans put it "a naughty boy".

  48. Well like I've said, you put in a rule and set precedence, ensure you maintain consistency and fair application of it. It does look like Liverpool has got a fair bit of this inconsistencies but I'd like to see this as something to bring unity to the club. I think Arsenal had those moments and they were closely knit to the common purpose of the club. Some positives would be (1) Carroll would get a chance now (2) KD & Comolli can bring their plans forward to secure a goal-scorer in Jan (3) The team would be closely knit and stronger mentally (4) Suarez may finally get a belated summer break now (he's been rather jaded lately I'm just afraid he may breakdown)
